Cannabis law in the United Kingdom is more nuanced than it first appears. Medically legal since 2018, recreational use remains harshly punished — while the CBD market has expanded dramatically. Here is what patients, residents and international visitors need to understand.

Class B: The Classification Under British Drug Law

The United Kingdom classifies controlled drugs into three categories: Class A, B and C — with Class A carrying the most severe penalties. Cannabis has been classified as Class B since 2009, when the Blair government's temporary reclassification to Class C was reversed. That reversal illustrates how politically charged the cannabis debate remains in Britain.

The legal consequences are clear: possession of cannabis can result in up to five years' imprisonment and an unlimited fine. Supply and cultivation carry penalties of up to 14 years. In practice, first-time possession of small quantities frequently results in a police caution or penalty notice rather than prosecution — but there is no legal guarantee of leniency.

Medical Cannabis: What Has Applied Since 2018

In November 2018, the Home Office amended the Misuse of Drugs Regulations 1971. From that point, registered specialist doctors were permitted to prescribe cannabis-based medicinal products (CBMPs). The change came in response to sustained public pressure, triggered by several high-profile cases in which children with severe epilepsy were denied effective cannabis-based medicines.

A crucial distinction: legalisation does not mean free availability. Cannabis remains a Schedule 2 controlled substance. Only GMC-registered specialists may prescribe. NHS GPs do not have this authority — at most, a GP may refer a patient to a specialist. In practice, the NHS prescribes cannabis medicinal products extremely rarely; the overwhelming majority of patients turn to private clinics.

What Remains Absolutely Prohibited

Regardless of nationality or country of origin, the following are illegal in Great Britain without exception:

  • Possession of cannabis without a valid UK prescription
  • Consumption of cannabis in public or private settings (without a prescription)
  • Cultivation of cannabis plants without a Home Office licence
  • Importation of cannabis — including for personal use
  • Supply to another person, even without payment

Anyone found with cannabis at a UK airport — whether arriving or departing — faces serious legal consequences. Even quantities that would be legal in Germany can lead to arrest under British law. A German cannabis social club membership carries zero legal weight here.

CBD Products: What Is Permitted

CBD (cannabidiol) is legal in the UK provided the THC content does not exceed 0.2 per cent. The UK market for CBD has expanded substantially: oils, capsules, gummies, topicals and teas are available in specialist shops, high-street pharmacies and supermarkets. Regulation sits with the Food Standards Agency (FSA), which treats CBD products as novel foods. For visitors wishing to take UK CBD products back to continental Europe, the German THC threshold of 0.3 per cent is slightly more permissive — retain receipts and certificates of analysis from reputable suppliers.

Government Policy: What Is and Is Not on the Table

As of 2026, no major British political party is proposing the recreational legalisation of cannabis. While Germany took a significant step with its Cannabis Act (CanG), the United Kingdom remains on a restrictive trajectory. The reform most likely to occur would be some form of decriminalisation for personal possession — but even that remains politically contested. Notably, despite this restrictive domestic policy, Britain is the world's largest exporter of medicinal cannabis, with licensed facilities operated by GW Pharmaceuticals (Jazz Pharmaceuticals) exporting primarily to North America.
