The United Kingdom occupies a fascinating position in the global cannabis landscape: medical cannabis has been legal since 2018, recreational use remains firmly prohibited, and yet Britain is the world's largest exporter of medicinal cannabis. The Legal Framework: What the Law Actually Says

Cannabis in the United Kingdom is classified as a Class B drug under the Misuse of Drugs Act 1971. Possession, cultivation and supply are all criminal offences. Possession carries a maximum penalty of five years' imprisonment and an unlimited fine; supply and production can result in up to 14 years. The recreational market that exists in countries such as Canada or certain US states does not exist here — and no major British political party is currently proposing to create one.

The critical exception: medicinal cannabis was legalised in November 2018 when the Home Office amended the Misuse of Drugs Regulations. The change came after intense public pressure, most notably the case of Billy Caldwell — a young boy with severe epilepsy whose cannabis oil was confiscated at Heathrow Airport, triggering a national media storm and government rethink. Since then, registered specialist doctors may prescribe cannabis-based medicinal products (CBMPs).

Medical Cannabis: Legal, But Not Easy to Access

The legalisation of medicinal cannabis sounded like a breakthrough — in practice, access remains severely constrained. NHS GPs (General Practitioners) cannot prescribe cannabis-based medicines directly. Only specialists registered with the General Medical Council (GMC) for this purpose are authorised to do so. The NHS itself is extraordinarily cautious: fewer than 20 NHS cannabis prescriptions have reportedly been issued since 2018.

The result: the vast majority of UK patients accessing medical cannabis do so through private clinics. Costs typically range from £200 to £400 per month for medication alone, with initial consultation fees of £50–£150. There is no NHS reimbursement. Approved indications include chronic neuropathic pain, multiple sclerosis spasticity (Sativex is formally licensed for this), chemotherapy-induced nausea, severe epilepsy in children (Epidyolex is licensed for Dravet syndrome and Lennox-Gastaut syndrome), PTSD and certain anxiety disorders. Each case is assessed individually by the prescribing specialist.

CBD Products: The Legal Grey Area

CBD (cannabidiol) products are legal in the UK provided THC content stays below 0.2 per cent. The Food Standards Agency (FSA) regulates CBD as a novel food. GW Pharmaceuticals — now part of Jazz Pharmaceuticals — operates vast licensed cultivation facilities in the UK, producing cannabis for export to markets in North America and beyond. British Sugar's Wissington site in Norfolk is among the largest such operations globally. The cannabis produced there is not available to UK patients.
