CBD in Germany: What Is Legal, What Is Not?

CBD products are widespread in Germany — from pharmacies to online shops. However, the legal position is more complex than is often portrayed. This article explains which CBD products are legal, what to look for when buying, and why health insurers do not cover the costs.

Legal Position: What Is Legal, What Is Not?

CBD (cannabidiol) is non-psychoactive and is not controlled under the German Narcotics Act (BtMG) — unlike THC. The basic rule is: CBD products are legal in Germany if the THC content is below 0.2%. For CBD oils intended for oral consumption, the EU Novel Food Regulation additionally applies: since CBD is classified as a novel food, manufacturers require authorisation from the EFSA. Many products on the market exist in a legal grey area — technically not yet approved, but factually tolerated.

Buying CBD Oil: What to Look For

CBD oil is the most popular CBD product in Germany. When purchasing, there are several key quality criteria. First: the extraction method. CO2 extraction is considered the gold standard — clean, without solvent residues. Second: the spectrum type. Full-spectrum oils contain all the natural cannabinoids and terpenes of the hemp plant, utilising the entourage effect. Broad-spectrum oils are THC-free; isolates contain only pure CBD. Third: third-party laboratory testing. Reputable manufacturers publish COA documents (Certificate of Analysis) from independent laboratories confirming THC content, CBD concentration and absence of contaminants.

CBD Flowers: The Legal Grey Area

CBD flowers are sold as smoking articles or aromatic flowers, but exist in a legal grey area. Although a legal CBD flower contains below 0.2% THC, police officers cannot distinguish them visually or by smell from illegal THC flowers. This has caused problems during checks in the past. When in doubt, always carry a receipt and the packaging to prove the legal purchase. Some German federal states adopt a considerably more restrictive approach than others.

6 Reputable CBD Brands from Germany and Europe

  • Hempamed — German brand, CO2 extraction, full COA transparency, organically certified
  • Nordic Oil — Scandinavian quality, full-spectrum and THC-free options, broad product range
  • Cibdol — Swiss manufacturer, medical quality standards, rigorous laboratory testing
  • Vitadol — Pharmacy-quality standard, available in Germany, medically recommended
  • Hanfosan — German manufacturer, organic hemp from EU cultivation, transparent production
  • Naturecan — British brand with EU presence, wide range, more affordable entry prices

5 Quality Criteria When Buying CBD

  • COA (Certificate of Analysis) — Independent laboratory certificate showing THC/CBD values and contaminant analysis must be publicly accessible
  • Extraction method — Prefer CO2 extraction; ethanol extraction is also acceptable; avoid cheap solvents
  • Organic certification — EU organic seal indicates pesticide-free cultivation; important as hemp absorbs contaminants from the soil
  • Full-spectrum vs. isolate — Full-spectrum for maximum entourage effect; isolate for a THC-free option in professions with drug testing
  • Third-party laboratory verification — The manufacturer's own laboratory is insufficient: independent analysis from accredited institutes is essential

CBD While Travelling: What Applies in the EU?

Within the EU, CBD products with below 0.2% THC are legal in most countries. However, extra caution applies when travelling to France, Sweden or Eastern European countries — the legal situation varies. Outside the EU (for example in Asia or the Middle East), even CBD can fall under the strictest drug laws. When in doubt: leave the product at home.

Health Insurance: Why Does It Not Cover CBD?

German statutory health insurers cover the costs of medical cannabis containing THC when a doctor prescribes it and the insurer consents. CBD products, by contrast, are classified as food supplements or cosmetics — not as medicines. They therefore fall outside the obligation to reimburse. Those wishing to use CBD for medical reasons and seeking cost coverage should explore the route of a medical cannabis prescription.
