One of the most common traps for cannabis tourists in the USA: airports are federal property. No matter which state you are in, the moment you enter an airport terminal, federal law applies. And under federal law, cannabis remains a Schedule I controlled substance.

Airport = Federal Property = Federal Law

The TSA (Transportation Security Administration) is a federal agency. It operates under federal law — not state law. This means that even if you legally purchased cannabis in Colorado, California or Nevada, you cannot bring it to the airport.

What Happens If the TSA Finds Cannabis?

The TSA primarily screens for security threats — weapons, explosives, dangerous liquids. They are not actively searching for drugs. However, if TSA agents discover cannabis, they are required to notify local law enforcement.

In Legal States: Officer Discretion

In states such as Colorado or California, local police officers have more room to exercise judgement. With small quantities below the legal limit, confiscation without arrest is common. However, this is not guaranteed — it depends entirely on the individual officer.

In Illegal States: High Risk

In states such as Texas or Florida, even small quantities can result in serious consequences, including arrest. As a foreign tourist, this is a risk simply not worth taking.

Domestic Flights: Still Illegal Between Legal States

A widespread misconception: "I'm flying from Denver to Los Angeles — both states are legal, so it must be fine." It is not. Airspace is federal territory. Every flight — regardless of the states involved — is subject to federal law.

  • Las Vegas to San Francisco: federal offence
  • Private flights and charters: Federal Aviation Authority = federal law

CBD and the TSA: What Is Actually Permitted?

CBD products containing less than 0.3% THC are legal at the federal level under the 2018 Farm Bill. TSA agents may allow such products through security — but only if the packaging clearly states the THC content.

  • CBD oil with less than 0.3% THC in original packaging: permitted
  • CBD gummies with clear labelling: permitted
  • Unknown products without labelling: risky
  • Any THC-containing product: prohibited
  • CBD products from the UK or EU (different standards): not guaranteed to be permitted

International Flights: Absolutely Off-Limits

Carrying cannabis on an international flight is a serious federal crime. In addition, the laws of your destination country apply. Attempting to bring cannabis from the USA back to the UK means potential prosecution in both countries and, for non-US citizens, possible consequences for future US visa applications.

Do's and Don'ts at US Airports

  • Finish or dispose of any cannabis before heading to the airport
  • Never pack cannabis in hand luggage or checked baggage
  • Be particularly careful with edibles — gummies can be hard to identify
  • CBD products: always carry in original packaging with COA labelling
  • If in doubt, leave the product behind rather than take the risk
  • Medical cannabis cards from other states carry no weight at the airport
